1. Introduction

Impactful Group Inc ("Impactful") dba Indieflix provides an online mental health literacy service called the Creative Coping Toolkit ("CCT" or "Service") designed to build resilience, self-awareness and coping skills.

By using the Service you agree to be bound by these terms and conditions ("Terms"). If you do not agree to all of the Terms, do not access or use the Service.

2. Our Service

2.1 Eligibility

To use the Service, you must:

  • Be at least 10 years of age
  • Reside in a country where the Service is available
  • Have an internet connection and compatible device

2.2 License

Impactful grants you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Service for your non-commercial purposes only. You obtain no rights to the Service except as permitted under these Terms.

2.3 Ownership

The Service is proprietary to and owned by Impactful. All title, ownership rights and intellectual property rights in and to the Service remain with Impactful.

2.4 Changes

We may modify, suspend or discontinue any aspect of the Service at any time with written notice. We reserve the right to restrict, suspend or terminate your access to the Service at any time.

2.5 Age Restrictions

The Service is designed for users ages 10 and older. By using the Service, you represent that you are at least 10 years old.

2.6 Availability

We aim to provide continuous availability of the Service but cannot guarantee it will be uninterrupted or error free.

3. Your Use of the Service

3.1 Account

You may need to create an account to use certain features of the Service. You must provide accurate account information and promptly update any changes. You are solely responsible for activity that occurs under your account.

3.2 Payment

Use of the Service requires payment of fees prior to receiving access. You must pay all applicable fees and taxes associated with your use of the Service.

3.3 Restrictions

You agree not to:

  •  Copy, modify, adapt, translate or create derivative works from the Service;
  •  Reverse engineer, decompile, disassemble or otherwise attempt to obtain code source;
  •  Circumvent any access restrictions or usage limits;
  •  Use the Service for any illegal, harmful, irresponsible, or inappropriate purpose;
  •  Use automated means to access the Service or harvest any data;
  •  Introduce any virus, worm, Trojan horse or other harmful computer code;
  •  Infringe Impacful's or any third party's copyright, patent, trademark, trade secret or other intellectual property rights.

3.4 The Creative Coping Toolkit

The Creative Coping Toolkit (CCT) is a video and curriculum based mental health literacy program owned by Impactful. Your purchase of the CCT provides you a limited license to use and share the program with your community, their immediate family members and households for personal, non-commercial use during the license term purchased. You may not:

  • Share, distribute or display the CCT outside of your immediate community, their family and household;
  •  Record, duplicate or recreate the CCT or any components in any way;
  •  Post any part of the CCT on social media or any other platform;
  •  Use the CCT for any commercial purpose whatsoever.

Any use of the CCT beyond the limited personal license grant is strictly prohibited and may result in termination of your access, liability for damages and other consequences.

The CCT does not provide medical advice or replace treatment by a licensed healthcare professional.

3.5 Data Collection & Privacy

We do not collect any emails or personal information beyond an administrator email and contact information. Our Service is FERPA, COPPA, and SOPPA compliant and follows CASEL guidelines for student data privacy. We do not share or sell any information to third parties, and only use data internally to provide customer support, engagement and impact analysis to improve the Service. Any third party software used also adheres to strict privacy standards.

4. Your Content & Information

You retain ownership of any content or information you submit through the Service.

Impactful will handle any personal information provided in accordance with our Privacy Policy.

5. Indemnification

You agree to indemnify, defend and hold harmless Impactful from any third-party claims, liability, damages and expenses arising from your use of the Service or violation of these Terms.

6. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED OR STATUTORY.

7. Limitation of Liability

IMPACTFUL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO THE SERVICE OR THESE TERMS.

8. Termination

We may suspend or terminate your access to the Service at any time for any reason, including for violation of these Terms. Provisions intended to survive termination shall remain in effect.

9. General Provisions

Washington law governs these Terms. These Terms constitute the entire agreement between you and Impactful. Our failure to exercise or enforce any rights does not constitute a waiver. We reserve all rights not expressly granted herein.
